PROTOCOLO ENTRE O MINISTÉRIO DAS RELAÇÕES EXTERIORES DA REPÚBLICA FEDERATIVA DO BRASIL E O MINISTÉRIO DOS NEGÓCIOS ESTRANGEIROS DA AUTORIDADE NACIONAL PALESTINA SOBRE COOPERAÇÃO TÉCNICA

O Ministério das Relações Exteriores da República Federativa do Brasil

e

O Ministério dos Negócios Estrangeiros da Autoridade Nacional Palestina
(doravante denominados as “Partes”),

Reconhecendo as contribuições prestadas pelo Brasil à Palestina;

Animados pela vontade de estreitar seus laços de amizade e de fraternidade; e

Determinados a desenvolver e aprofundar suas relações de cooperação técnica;

Decidem celebrar o presente Protocolo, nos seguintes termos:

1. As Partes dispõem-se, quando para tanto solicitadas, a prestar cooperação técnica mútua nas áreas de:

a) agropecuária;
b) esportes;
c) eleitoral;
d) comunicação;
e) desenvolvimento urbano;
f) desenvolvimento social;
g) saúde;
h) educação; e
i) outras áreas que as Partes considerem necessárias ao desenvolvimento da cooperação técnica.

2. As Partes poderão estabelecer parcerias com instituições dos setores público e privado, organismos e agências internacionais, e organizações não-governamentais para a implementação de atividades de cooperação técnica nas áreas mencionadas.

3. As atividades previstas no presente Protocolo serão coordenadas, na Autoridade Nacional Palestina, pelo Ministério dos Negócios Estrangeiros, que designará, por via diplomática, a instituição ou as instituições responsáveis pela sua execução.

4. As atividades previstas no presente Protocolo serão coordenadas, na República Federativa do Brasil, pela Agência Brasileira de Cooperação (ABC) do Ministério das Relações Exteriores, que indicará a instituição ou as instituições responsáveis pela sua execução.

5. As Partes realizarão reuniões para acordar os termos da cooperação a ser desenvolvida.

6. As ações e atividades previstas no presente Protocolo estarão sujeitas às leis e aos regulamentos em vigor na República Federativa do Brasil e na Autoridade Nacional Palestina.

7. O presente Protocolo entrará em vigor na data de sua assinatura e terá vigência de dois (2) anos, sendo automaticamente renovável por igual período.

8. Quaisquer controvérsias relacionadas à implementação do presente Protocolo serão dirimidas por negociação direta entre as Partes.

Feito em Salvador, em 20 de novembro de 2009, em dois exemplares originais, nos idiomas português e inglês, sendo ambos os textos igualmente autênticos.

PROTOCOL BETWEEN THE MINISTRY OF EXTERNAL RELATIONS OF THE FEDERATIVE REPUBLIC OF BRAZIL AND THE MINISTRY OF FOREIGN AFFAIRS OF THE PALESTINIAN NATIONAL AUTHORITY ON TECHNICAL COOPERATION

The Ministry of External Relations of the Federative Republic of Brazil

and

The Ministry of Foreign Affairs of the Palestinian National Authority
(hereinafter referred to as the “Parties”),

Acknowledging the contributions made by Brazil to Palestine;

Encouraged by the will to strengthen their existing ties of friendship and fraternity;

Willing to develop and deepen their relations of technical cooperation,

Have agreed to sign the present Protocol:

1. The Parties are willing to offer, on the basis of reciprocity and whenever called upon, mutual technical cooperation in the following areas:

a) Agriculture and livestock;
b) Sports;
c) Electoral;
d) Comunication;
e) Urban development;
f) Social development ;
g) Health;
h) Education; and
i) Other areas in which the Parties consider necessary to the development of technical cooperation.

2. The Parties may establish partnerships with public and private sector institutions, as well as with international and non-governmental organizations and entities, in order to implement technical cooperation activities in the above mentioned areas.

3. The activities foreseen in this Protocol will be coordinated, in the Palestinian National Authority, by the Ministry of Foreign Affairs, which will appoint, through diplomatic channels, the institutions(s) responsible for their execution.

4. The activities foreseen in this Protocol will be coordinated, in Brazil, by the Brazilian Cooperation Agency of the Ministry of External Relations (ABC), which will appoint, through diplomatic channels, the institutions responsible for their execution.

5. The Parties will hold meetings in order to agree on the terms of the cooperation to be developed.

6. The actions and activities foreseen in this Protocol are subject to the laws and regulations in force of the Federative Republic of Brazil and of the Palestinian National Authority.

7. This Protocol will come into effect on the date of its signature and will remain valid for the period of two years, automatically renewable for an equal period.

8. Any dispute related to the implementation of this Protocol will be settled by direct negotiations between the Parties.

Done in Salvador, on November 20th 2009, in two original copies, in Portuguese and in English, both texts being equally authentic.
